Grabar Law Office Files Class Action Against Capital One and Amazon.com For Failures To Safeguard Consumer Data

August 5, 2019 – Grabar Law Office has filed a putative class action against Capital One Financial Corp. and Amazon.com, Inc. for failures to properly safeguard Capital One consumer data after Capital One revealed it had been the target of data theft in which 106 million people had their personal information stolen by a hacker who is now facing federal criminal charges.

It is alleged that Capital One failed to institute proper security practices for protecting the sensitive information of their credit card customers.

Capital One has stated that it became aware of the data breach on July 19, and that it impacted about 100 million U.S. residents and 6 million Canadian residents who had, or applied for, Capital One accounts. The hack exposed an estimated 140,000 Social Security numbers and about 80,000 linked bank account numbers.

Most of the stolen data included personal information like names, addresses, postal codes, phone numbers, email addresses, dates of birth and self-reported income, credit scores, credit limits, balances, payment history, contact information and other transaction data over the past three years, according to Capital One.

According to the criminal complaint charging Paige A. Thompson with computer fraud and abuse, the hacker gained access to the data sometime between March and July by compromising Capital One’s servers at a cloud computing company.

Capital One expects the incident to cost $100 million to $150 million this year.
